2 questions about rail roads?

Caryl Mclaen: Problem Child: I don't think they are going to leave or need something that is rusty and just discarded off to the side of the tracks. (Like 20 or 30 feet.) And as I said, most of the stuff that I saw that my friend thinks is discarded is either really rusty and 90% not usable or discarded and looks to be slightly broken. Like we saw this rod that looked so out of place.

Hugo Pittari: None of it. The ties are RR property and so are any items in the area. railroads have what is called right of ways. That includes the tracks and area on either side, usually for a pretty good distance on either side. So, thats actually private property. If you take stuff off of private proerty, you are stealing. Could someone come in your backyard and take something just because you weren't using it? Exactly how do you or your friend know its discarded. Did you ask the RR? RR's leave ties in places so they are there for future repairs.Rails, ties, clips etc are frequent! ly left at various locations. Its not yours, so you don't belong taking it and if the RR Police catch you, you can be arrested for theft and tresspassing....Show more

Coy Tapley: The metal rails are made from hardened steel. If the rails are sitting well off the right of way of the railway, they would be considered discarded and free for the taking. If you are referring to steel rails that are sitting alongside tracks, they are more than likely there for repairs being made or about to be made.
